In Fort Lauderdale the EPA requires certified Lead Paint Remodeling Companies. Paul Davis Restoration and Remodeling was one of the first lead certified construction contractors in South Florida.

U.S. Environmental Protection Agency rules taking effect April 22 require remodeling work on homes built before 1978 to be undertaken only by contractors certified by the agency in lead-safe practices. (An EPA-certified contractor isn’t necessary if the work doesn’t disturb the paint, but that can be hard to know up front.) The National Association of the Remodeling Industry recommends that home owners assume lead is present if their home was built before 1978 unless they’ve had it tested and found it lead-free.  Certified remodelers are required to display their EPA-certified training certificate to home owners.  For a compliance guide, search for "lead paint renovation rule" at REALTOR.org.

  • The new certification in lead-safe work practices is required for anyone being paid to do work on projects where lead paint may be disturbed. And, yes, it is the law. The program necessitates new training for contractors, property managers and other workers who disturb painted surfaces in houses, apartments and child-occupied facilities such as schools or day-care centers built before 1978.
  • The program is focused on protecting the building occupants by requiring contractors to identify lead-based paint and treat it properly in the course of their construction activities. Therefore, if the contractor is not impacting a lead painted surface, then the rules do not apply.
  • The new rules apply to lead-based paint inside and outside of residential or child-occupied facilities. Other rules already exist that require similar, or more stringent, controls on lead in homes that are supported by federal money such as HUD loans.
  • The $32,500 fine appears to be a maximum per violation. There still is plenty of discussion regarding whether a violation would be by project, by person, or by day.
